Terms of Service

1. Overview

AbollyHost was established on June 15, 2017 and provides web hosting infrastructure including shared hosting, anonymous hosting, reseller hosting, VPS servers, dedicated servers, domain registration, and related services. These terms govern your access to and use of all such services.

These Terms shall be read together with our Privacy Policy, Acceptable Use Policy, Refund Policy, Service Level Agreement, and DMCA & Copyright Policy, all of which are incorporated by reference into this Agreement.

2. Hosting Plan Tiers & Copyright Policy

AbollyHost operates two distinct categories of hosting with fundamentally different copyright enforcement policies. You are responsible for choosing the correct plan for your content.

2.1 Standard Shared Hosting & Standard Reseller Hosting

Standard Shared Hosting and standard Reseller Hosting plans are fully DMCA-compliant. By purchasing a standard hosting plan, you agree to the following:

• You will only host content that you own, hold a valid licence for, or that is in the public domain;
• You acknowledge that any website on your account that is the subject of a valid, substantiated DMCA copyright takedown notice will be permanently suspended with immediate effect;
• No prior warning will be issued before suspension on receipt of a valid DMCA notice — the act of hosting infringing content on a standard plan is itself a violation of this Agreement;
• No refund will be issued for accounts terminated due to copyright infringement.

2.2 Anonymous Hosting (cPanel & DirectAdmin)

Our cPanel Anonymous Hosting and DirectAdmin Anonymous Hosting plans are hosted on servers located in offshore jurisdictions outside the United States. These plans operate under a different copyright policy:

• US DMCA (Digital Millennium Copyright Act) takedown notices are not automatically actioned on this infrastructure;
• DMCA notices will be reviewed but content will not be removed solely on the basis of a US-jurisdiction copyright claim;
• Action will only be taken where content violates our Absolute Prohibitions (see Section 7), or where a valid court order from a jurisdiction with authority over the server's physical location is presented;
• Anonymous Hosting plans provide significantly greater content freedom for legitimate purposes such as media hosting, privacy-sensitive content, and material that may face over-broad US copyright enforcement.

3. Eligibility & Account Creation

To register for and use our services, you must:

• Be at least 18 years of age or have legal capacity to form a binding contract in your jurisdiction;
• Provide accurate, current, and complete registration information;
• Maintain and update your account information to keep it accurate and current;
• Not be prohibited from receiving services under applicable law.

AbollyHost reserves the right to refuse service to any person or entity at its sole discretion. Accounts registered with false information may be terminated immediately without refund.

4. Account Responsibilities

You are solely responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Keep your password secure and not share it with any third party;
• Notify AbollyHost immediately upon discovering any unauthorised use of your account;
• Accept responsibility for all activities conducted through your account, whether authorised by you or not;
• Ensure all users accessing services through your account comply with these Terms and our AUP.

Reseller Accounts

Resellers are responsible for ensuring their end-customers comply with this Agreement and our Acceptable Use Policy. You must correctly assign your customers to the appropriate hosting tier (standard or anonymous) based on their content. Violations by your customers are treated as violations by your account. You may not represent to your customers that they are exempt from any AbollyHost policy.

5. Services, Billing & Payment

5.1 Service Activation

Services become active upon receipt of payment and completion of any required verification. AbollyHost reserves the right to delay activation pending payment verification.

5.2 Billing Cycles

Services are billed in advance on a monthly, quarterly, semi-annual, or annual basis as selected at order. Invoices are issued prior to the renewal date. Non-payment within the grace period will result in service suspension.

5.3 Late Payment & Suspension

Invoices unpaid beyond 7 days after the due date may result in service suspension. After 14 days of continued non-payment following suspension, AbollyHost reserves the right to terminate the account and permanently delete all associated data, with no obligation to provide backup recovery.

5.4 Price Changes

AbollyHost reserves the right to revise pricing at any time. Existing customers will be notified at least 14 days before any price change takes effect on their renewal.

5.5 Taxes

All stated prices are exclusive of applicable taxes. You are responsible for any taxes, levies, or duties imposed by your local jurisdiction.

6. Copyright & DMCA — Summary

AbollyHost's copyright enforcement policy varies by plan type. This section is a summary — the full policy is in our DMCA & Copyright Policy.

• Standard Shared Hosting: Fully DMCA-compliant. Valid copyright notices result in immediate permanent suspension of the reported website with no prior warning and no refund;
• Anonymous Hosting (cPanel & DirectAdmin): Offshore, DMCA-ignored. US DMCA notices are not automatically actioned. We only take down content that violates our Absolute Prohibitions or where compelled by a court order from an applicable jurisdiction;
• All Plans: Content in our Absolute Prohibitions (Section 7) is removed immediately regardless of plan type.

7. Prohibited Content — Absolute Restrictions on All Plans

• Child Sexual Abuse Material (CSAM): Any content sexually exploiting or depicting minors — reported to INTERPOL and Nigerian law enforcement immediately;
• Phishing & Credential Harvesting: Fake login pages, brand impersonation infrastructure, or any system designed to steal credentials or financial data from individuals;
• Financial Fraud: Ponzi schemes, advance-fee fraud (419) platforms, fake investment portals, or operations designed to defraud people of money;
• Malware Distribution: Ransomware, trojans, botnets, keyloggers, spyware, or exploit kits;
• DDoS-for-Hire: Stresser or booter services whose primary purpose is facilitating attacks against third parties;
• Terrorism & Violent Extremism: Content that recruits for, glorifies, or facilitates acts of terrorism or mass violence;
• Non-Consensual Intimate Imagery: Distribution of intimate images without verified, ongoing consent.

8. Suspension & Termination

8.1 By AbollyHost — For Cause

We reserve the right to suspend or terminate your account at any time, with or without prior notice depending on severity, if you have violated this Agreement or our AUP, your account is being used to harm our infrastructure or other customers, or payment obligations remain outstanding beyond the grace period.

The following violations result in immediate termination without prior warning and without refund:

• Any Absolute Prohibition violation (Section 7);
• Receipt of a valid DMCA notice on a standard Shared Hosting account;
• Active malware, phishing, or spam originating from your account;
• Participation in or facilitation of DDoS attacks.

8.2 By You

You may cancel your services at any time via your client area. Cancellations become effective at the end of the current billing cycle unless you are eligible for a refund under our Refund Policy.

8.3 Data After Termination

Upon termination, AbollyHost may permanently delete all data, files, and backups. You are responsible for maintaining your own backups at all times. AbollyHost accepts no liability for data loss following termination.

9. Limitation of Liability & Disclaimers

AbollyHost provides all services on an "as is" and "as available" basis. To the maximum extent permitted by law, AbollyHost's total aggregate liability shall not exceed the total fees paid by you in the three months preceding the event giving rise to the claim.

AbollyHost shall not be liable for any indirect, incidental, consequential, punitive, or special damages; loss of data, revenue, or business opportunities; downtime caused by factors outside our reasonable control including DDoS attacks, upstream provider failures, or force majeure events; or actions and content of third-party users on our platform.

10. Indemnification

You agree to defend, indemnify, and hold harmless AbollyHost, Abolly Digital Solutions, their directors, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising out of or related to your use of the services, content you host, any activity conducted through your account, or your violation of any applicable law or regulation.

11. Governing Law & Dispute Resolution

This Agreement is governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Disputes shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration under Nigerian arbitration law. The venue for any legal proceedings shall be Osun State, Nigeria, unless both parties agree otherwise in writing.

12. Modifications to Terms

AbollyHost reserves the right to modify these Terms at any time. Material changes will be communicated via email to your registered address at least 7 days before taking effect. Continued use of our services after the effective date constitutes acceptance of the revised Terms. If you disagree with a material change, you must cancel your services before the effective date.
