DMCA & Copyright Policy
This policy explains exactly how AbollyHost handles copyright complaints across our different hosting plans — and what that means for you.
1. Quick Overview — Two Hosting Tiers, Two Policies
AbollyHost is not a one-policy-fits-all provider. We operate two clearly distinct hosting environments, each with its own copyright enforcement position. Understanding which tier you are on is essential.

2. Shared Hosting — Fully DMCA-Compliant
Our standard Shared Hosting infrastructure is hosted in environments where we are obligated to respect valid copyright claims. We take intellectual property rights seriously and act swiftly when a properly documented complaint is received.
What Happens When We Receive a DMCA Notice for Shared Hosting
- Our abuse team reviews the notice to confirm it meets the requirements listed in Section 7;
- If the notice is valid and the infringing content is confirmed to exist on the reported shared hosting account, the website is suspended immediately and permanently;
- The account holder is notified by email of the suspension and the reason;
- No refund is issued for services terminated due to copyright infringement;
- Repeated infringement across multiple accounts may result in the account holder being permanently barred from our services.
3. Anonymous Hosting — Offshore & DMCA-Ignored
Our anonymous hosting servers are purposefully located in jurisdictions where the US Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512) does not apply. This means:
- DMCA notices from US-based copyright holders will be logged but not automatically actioned;
- Your content will remain online unless it falls within our Absolute Prohibitions (see Section 5);
- You are protected from aggressive, frivolous, or over-broad US copyright enforcement;
- Your identity and server location are shielded through our anonymous infrastructure.
What We Do With DMCA Notices on Anonymous Hosting
When we receive a DMCA notice targeting an account on our Anonymous Hosting infrastructure, we:
- Log the notice and assign it a reference number;
- Review the notice to determine whether it involves content in our Absolute Prohibitions (Section 5);
- If the content does not fall within our Absolute Prohibitions, no takedown action is taken;
- If the claimant requests acknowledgement, we respond advising that our servers operate outside US jurisdiction and the notice does not have binding authority over our infrastructure;
- We only act if a valid court order from a jurisdiction with authority over our server's physical location is presented.
4. Which Plan Is Right for You?

5. Absolute Prohibitions — Applies to ALL Plans
- Child Sexual Abuse Material (CSAM): Any content that sexually exploits or depicts minors. Reported to INTERPOL and Nigerian law enforcement immediately, without prior notice;
- Phishing & Credential Harvesting: Fake login pages, brand impersonation sites, or infrastructure designed to steal personal credentials or financial data from real individuals;
- Financial Fraud Infrastructure: Ponzi schemes, advance-fee fraud (419) platforms, fake investment sites, or any operation designed to defraud identifiable people;
- Malware & Exploit Distribution: Ransomware, trojans, botnets, keyloggers, exploit kits, or any software whose primary function is to harm or compromise computer systems without authorisation;
- DDoS-for-Hire Services: Stresser services or booter platforms whose primary purpose is facilitating network attacks against third parties;
- Terrorism & Mass Violence: Content that recruits for, glorifies, or facilitates acts of terrorism, genocide, or mass violence;
- Non-Consensual Intimate Imagery (NCII): Distribution of intimate images of individuals without their verifiable, documented consent.
6. How to Submit a Copyright Notice
All copyright and intellectual property notices must be directed to our abuse and compliance team in writing. Please specify in your notice whether the hosting account in question is on Shared Hosting or Anonymous Hosting, as this determines how we process your complaint.
Identify the Hosting Type
Determine whether the infringing site is on our standard Shared Hosting or Anonymous Hosting infrastructure. This affects processing time and likely outcome.
Prepare Your Notice
Gather all required information outlined in Section 7. Incomplete notices cannot be actioned and will be returned with a request for the missing information.
Submit via Email
Send your notice to [email protected] with subject line: "Copyright Notice — [Domain Name]". Include whether the site is on Shared or Anonymous hosting if known.
Acknowledgement
We will acknowledge receipt within 72 hours and provide a reference number for your records.
Review & Determination
Our compliance team reviews your notice. Shared Hosting: action taken within 24 hours of verification. Anonymous Hosting: determination within 14 business days based on jurisdiction and absolute prohibitions.
7. Requirements for a Valid Notice
To be considered actionable, your copyright notice must include all of the following. Missing any item will result in the notice being returned as insufficient:
- Identification of the copyrighted work — a specific description or reference to the original work you own and claim has been infringed;
- Exact URL(s) of the infringing content — the specific page or file URL. General claims such as "all content on [domain]" are not sufficient;
- Proof of rights ownership — documentation demonstrating you own or are authorised to act on behalf of the copyright holder (e.g. registration certificate, licensing agreement, or signed authorisation letter);
- Full contact information — your legal name, company name (if applicable), email address, mailing address, and phone number;
- Jurisdiction statement — a statement identifying the legal jurisdiction under which you are asserting your rights and explaining why that jurisdiction applies to this matter;
- Good faith declaration — a written statement that you have a good faith belief the disputed use is not authorised by the copyright owner, its agent, or the law;
- Accuracy declaration — a statement under penalty of perjury that the information provided is accurate and that you are the rights holder or are authorised to act on their behalf;
- Signature — your physical or electronic signature.
8. Our Review Process
For Shared Hosting Accounts
Once we receive a valid, complete copyright notice targeting a Shared Hosting account:
- We verify the infringing content exists at the reported URL;
- We confirm the notice meets all requirements in Section 7;
- If both are confirmed, the hosting account is suspended immediately and permanently;
- The account holder receives an email notification explaining the suspension and citing the copyright complaint;
- No warning is issued prior to suspension — the act of hosting infringing content on Shared Hosting constitutes a violation of our Terms of Service.
For Anonymous Hosting Accounts
Once we receive a copyright notice targeting an Anonymous Hosting account:
- The notice is logged and assigned a reference number;
- We review it against our Absolute Prohibitions (Section 5);
- If the content does not violate our Absolute Prohibitions, no takedown action is taken and we notify the claimant of our offshore jurisdiction position;
- We only take action if a valid court order from a jurisdiction with legal authority over the server's physical location is presented;
- The affected customer is not notified that a notice was received unless we determine action is required.
9. Counter-Notices
If you are a Shared Hosting customer whose website was suspended following a copyright complaint and you have a good faith belief that the suspension was made in error or the content is not infringing, you may submit a counter-notice. Your counter-notice must include:
- Your full name, address, phone number, and email address;
- Identification of the content that was suspended and its former URL;
- A statement under penalty of perjury that you have a good faith belief the content was suspended as a result of mistake or misidentification of the material;
- Your consent to the jurisdiction of a court competent to resolve the dispute;
- Your physical or electronic signature.
Submit counter-notices to: [email protected] with subject: "Counter-Notice — [Your Domain]". We will review and respond within 10 business days. Restoration of service is at AbollyHost's sole discretion pending investigation.
10. Misuse of the Notice System
If AbollyHost determines that a notice was submitted in bad faith — including to censor legitimate speech, suppress a competitor, or harass an individual — we reserve the right to:
- Reject the notice without action and restore any affected account;
- Report the bad-faith notice to relevant legal authorities;
- Pursue or assist affected customers in pursuing civil remedies against the filer;
- Permanently block the filer from submitting future notices.
